The scope of the China RoHS law was developed as a reaction to the EU RoHS directive: many product types in the scope of EU RoHS are not within the scope of the China RoHS.

Electronic radar product, Electronic telecommunications product, Broadcast and TV product, Computer product, Household electronic product, Electronic measuring instrument, Special electronic apparatus, Electronic component, Electronic applications equipment, Electronic raw material and packaging materials are in the China RoHS scope, while toys are not included.

Unlike the EU RoHS Directive which lists categories of exempted products, the China RoHS law lists out products to be covered.

The covered products are identified by Chinese Ministry of Information Industry (MII), MII does not either plan to translate the initial list of electronic information (EI) products into English, or establish any formal administrative process for clarifying questions regarding covered products.

Raw materials and components are covered in the range of China Administration Measures, while only finished electric and electronic equipments are covered in EU RoHS.

Furthermore the China RoHS law requires marking standards for all products that are identified in the catalogue.

The marks must be on the products from March 1, 2007.

There are three marks required: A label defines whether or not the products contain any of the six hazardous substances.

If they are present, it is required to provide a table, in the product documentation, to identify which hazardous substances are contained and in the component(s) they are present in.

Packaging material must be disclosed on the outside package.

The concept of "Put on the market" is different from EU RoHS directive in China, from March 1, 2007 all products from the docks to retail shelves must be compliant.
